Tag Entertainment Update 4/23/08

Over the past weekend I talked with the District Attorney in Portland, Oregon. He was very helpful in understanding the Victim Impact Statement.

His comments:

The Judge reads all impact statements. The words the victimswrite have more influence impact and hold more weight than the defense attorneys or prosecuting attorney.

The Judge will have hundreds of impact statements to read. It is very important that all our impact statements are short and to the point. Don't write several sentences explaining one point. Limit to one page if possible. Use numbers or bullets to label the points you want to make. Make it easy to read.

The Oregon District attorneys opinion and from his experience said..at the sentencing, the seized assets to be distributed to us victims will likely be the extent of what all 800+ victims will receive in this case. Rarely do victims receive additional restitution above and beyond the initial seized assets. We will learn the dollar amount of the seized assets at the September 22, 2008 sentencing.

We can make requests to the Judge and every one of us should take this opportunity. After the conversation with the Oregon District attorney last weekend I have come to the conclusion we all should request:

* Request Maximum prison sentence will full restitution.

* Request NOT changing sentencing date of September 22, 2008 so victims can attend.

I hope this has been helpful in encouraging all to write their impact statements to the Judge. It's imperative that each one informs the Judge, through the impact statements, how this crime has affected your life. Be sure to include how much you invested, your name and address.

Conversation with Jeff Alabaso 4/15/2008Questions I asked Jeff:1. Being a plea-bargain was entered into does that predetermine Austin's sentence?The ultimate sentencing decision is done by the judge on September 22. Our impact letters will give the judge another perspective other than the attorneys input. It's important everyone writes their letters. Attached is guidelines from Jeff Alabaso's office...a question and answer format to give ideas of what you might want to addressed in your impact letter. Return to the Victim Notification Office, address is at the top of the cover sheet, right side, and the name of the judge, case name and court docket number is enclosed in the message of this cover letter.

2. Who will track, monitor and enforce Austin to pay restitution? If he has prison time a probation officer will be assigned upon release from prison and will monitor payments. When probation has ended the Financial Litigation Department will monitor the judgment made by the Judge on September 22 and enforce restitution for the remainder of the 20 years. This doesn't guarantee Austin will ever work an honest wage to pay us back. Jeff was not aware of how much of a pay check can be garnished for restitution if any. The Financial Litigation Department will have those answers after the Judge places a judgment on Austin at the sentencing on September 22. The Justice Department will put a high propriety on this case because of the number of victims and the dollar amount of fraud involved.

3. Is the FBI done seizing assets being there is no one on the case now? All Jeff could say is: he knows the assets that were seized at still there for restitution (he would not disclose the dollar amount of assets seized). We will find out on September 22 the dollar amount of those assets.

Jeff also said the more that can show up for the sentencing the better. Anyone who wants to speak before the Judge on that day is welcomed as well. Austin's attorneys will speak as well as the prosecuting attorney for the District Attorney's office. This case is not being taken lightly because of the magnitude of the dollar amount and number of victims involved. So in relaying all this lets not give up hope and be sure to do what part we can by writing our impact letters. It's best to write the letter in your own words...if you cannot do this then at least fill in the blanks and mail in the question-answer Individual Victim Impact Statement/Financial Crime form attached.

Your attention and your action is requested on the below matter.

Victim Impact Letter

One of our fellow investors, Nancy Draper, has done a tremendous amount of follow-up and has found out from Jeff Alabaso at the Victims Notification's Office that it would behoove each of us to write a letter to the judge who will be sentencing Steve Austin on September 22, 2008. It is important that you write a compelling letter describing the impact Steve Austin's fraud has had on you, your family, your lifestyle, your savings, and anything else that might help the nudge understand the magnitude of Steve's crime as it affects individual investors. The judge needs to understand that Steve perpetrated his crimes against honest, hard-working individual investors who might be financially destroyed by his crimes rather than large corporate investors who could afford to cover their losses.

You need to include as much detail as you can in your letters. Be specific, supply correct facts and describe how you have been impacted. Put thought into your letters. This is our opportunity to make an impact, to finally have some influence as these will be sent to Judge Margaret M. Morrow in July 2008, approximately two months before sentencing on September 22, 2008.

I urge each of you to write your letters immediately as Jeff Alabaso did advise that Steve's lawyers could plea for a change of sentencing date. This is why it is important to get your letters written and submitted now.

Victim Impact Statement

Additionally, the Victims Notification Office will be sending out the Victims Impact Statement in June to all investors. But it is best not to wait for this form as it may be delayed in the mail and nonetheless will give a very short turnaround time for you to submit your impact statement. Better to send, as soon as possible, your letter. And of course you should also file the victim impact form if you receive it in the mail. This form gives guidelines for each of us to write a letter to Judge Margaret Morrow addressing how we the individual investors have been impacted by this crime. Due to the magnitude of this case the Judge might not send out this form but it behooves us to eachwrite the letters. It's up to the judge to determine how much each of the victims will get towards our individual restitution.

Also, we, the victims, will have an opportunity to speak before the judge on September 22, 2008, to plea the impact on us from this crime.

New Information

1 - The Plea-Agreement entered into at the hearing is: Steve Austin pleaded guilty to Tax Evasion and Fraud with the movie Funny Money. In this plea-agreement Austin agreed to restitution to all other investors that received a letter from the District Attorney's office. WE ARE INCLUDED in the restitution agreement. This restitution will go for 20 years or the death of the defendant. Which ever happens first.

2 - Assets have been confiscated but the dollar amount cannot be disclosed at this time. So how much will go towards our individual loss we have incurred is unknown until September 22, 2008 sentencing at 1:15pm in LA.

3 - At this time the sentencing is open to the public. We'll see when it gets closer to September 22, 2008 if we get to attend or not. The more that can attend the more of a statement and impact we can make. Sentencing will take place at the Edward R. Roybal Federal Building and Courthouse, located at 255 E. Temple Street, in Los Angeles, California. No room number yet. That willcome in about August, 2008.

The following is the letter, regarding our TAG Entertainment investment. I submitted this complaint letter to the California Department of Corporations and the FBI. TAG is currently under investigation.

RE: Complaint against Tag Entertainment

In April of 2003 I received a call from someone who said, “Your check is in the mail”. Through further conversation I found out it was a company seeking money for a movie production, Santa Trap. The caller, Allen Agler, representing Tag Entertainment (TAG), said that if I invested into Santa Trap I would receive a dividend check, and this would be the first of many checks to come.

I checked with the local Better Business Bureau and found no complaints against TAG. Allen Agler called me on numerous occasions asking for a $25,000 investment, I was still apprehensive. He reiterated that there are only a few subscriptions available and I would have to hurry to get into this opportunity.

Allen Agler and I talked on several occasions. He worked hard to develop a trusting relationship with me, using important values that I have, family values and religious ethics. He said he was a Christian and those words gradually put me over the hump to win his trust. He also said he had his mother invest into Santa Trap and he wouldn’t do anything that would harm her.

I was still a little apprehensive so Allen Agler suggested that he could do something for me according to his manager. Instead of investing the $25,000, or one unit, I could invest a smaller amount. He suggested a half a unit; however, I was still reluctant. He said it wasn’t common but he would let me invest a quarter of a unit, $6,250. He also stated that I would receive a dividend check of $600 and if I invested more I would receive more in dividends.

I received the paper work a few days later. Allen Agler called me when the paper work arrived. We briefly went over the paper work and I specifically asked him about the risk factor because there was a statement that said something to the fact that there are no guarantees. Allen Agler stated that, "it’s just legal jargon that some attorneys had to write. Don’t worry, this is a sound opportunity". By now I had developed a trusting relationship with Allen Agler, after-all he kept reiterating the Christian vales that he had, honesty and trust. Essentially, I had put my total trust in Allen Agler. He explained he knew the movie business and I would profit immensely.

During this time I was under the impression that the movie Santa Trap was not produced. It wasn’t until later that I found out the movie was already produced and distributed. (Apparently it was lacking funding so TAG used their fundraising program, of selling subscriptions into a Limited Partnership, to acquire more funds.)

A few days later Allen Agler called me again. By now I felt I had a trusting friend in the movie industry. He told me of another movie that was in the works, Black Beauty. He said the script was taken from the book, Black Beauty and Black Beauty was the 2nd most read book in the world, only the Bible being the first. He was looking for me to invest $100,000. This movie was a sure thing. Allen Agler stated that Joey Travolta of Travolta Family Films was going to direct the movie and Robert Wagner was going to star in the movie. (This was written in the contract too.) He also said that John Travolta may make an appearance in the movie since the Travolta Family was involved in its making.

Allen Agler further stated that Lou Pearlman was partnering with TAG. I learned that Lou Pearlman was a big businessman in the music industry and anyone with that clout knew that TAG was a legitimate movie company. (It wasn’t until later that I learned Lou Pearlman only worked with TAG on one movie production, I was led to believe that Lou Pearlman had partnered with TAG in all movie productions.)

Allen Agler also said that with Black Beauty, I could go out and buy that new house. I commented to Allen that I did not have liquid assets to make another investment, they were tied up in retirement accounts. Allen said that was no problem, I could take my current IRA money and place it as an IRA investment with TAG.

By now I had a very good relationship with Allen Agler, he had won my trust and was looking out for me. I told him that I couldn’t do $100,000 but I was able to do $50,000. Allen Alger said I could transfer money from my traditional IRA to a TAG IRA holding with Sterling Bank. I agreed to do the transaction.

Several weeks later I called to speak with Allen Agler and had found out that he had was no longer working with TAG. There was no real response to the "why" he left or where he went.

When Allen left I began probing more into TAG, seeking out other TAG investors and learned that Allen Agler had lied to me. First, Santa Trap was already produced and distributed. Secondly, Black Beauty was not directed by Joey Travolta and the movie had nothing to do with the Travolta Family. Thirdly, Robert Wagner did not have any role in Black Beauty.

Over the course of several months during 2004-2005 I called TAG to find out about the Black Beauty movie production. It was always on hold do to set backs.

I contacted Rena, a TAG representative and asked for my money back. She “danced around” my request and said that movies typically take years before money is made. She specifically sited, “Miracle on 34th Street” and said, "Look how long that movie took to make money". (I was led to believe I’d have my principle and additional returns within months, not years!)

I was miss-led into a fraudulent investment. Allen Agler, representing TAG, won my trust and deceived me into entrusting my retirement money with TAG. I spoke with Steve Austin in Oct. of 2006 and asked for my money back but he replied that he was re-organizing the company to help all of the investors of TAG.

I am still pursuing getting my money refunded. The investment I made with TAG was not what I was led to believe it was.
